Can Americans Finally Make Whiskey at Home? The Supreme Court Will Decide

Artfully Bourbon / October 20, 2026

A 158-year-old federal ban on home distilling is headed to the nation's highest court.

You can legally brew beer or make wine at home. But distill your own whiskey? That's been against federal law since 1868.

That could change. On October 19, the U.S. Supreme Court agreed to hear a constitutional challenge to the federal prohibition on home distilling, potentially opening the door for Americans to legally produce their own spirits.

What to know

The case comes after two federal appeals courts reached opposite conclusions about the same law.

The Fifth Circuit ruled the prohibition unconstitutional, while the Sixth Circuit upheld it. At the heart of the disagreement is whether Congress has the authority to prohibit home distilling as a way to protect federal alcohol tax revenue.

The Supreme Court will now settle that disagreement, with arguments expected in 2027 and a decision likely by June.

Key Details

  • Law Enacted: 1868
  • Issue: Federal ban on home distilling
  • Fifth Circuit: Ruled ban unconstitutional
  • Sixth Circuit: Upheld ban
  • Supreme Court: Agreed to hear case October 19, 2026
  • Arguments: Expected in 2027
  • Decision: Expected by June 2027
  • Current Law: Home distilling remains federally prohibited

Why it matters

For whiskey enthusiasts, this could open up an entirely new side of the hobby.

Imagine experimenting with your own mash bills, fermentation, distillation and aging at home. Not just blending or finishing whiskey, but actually making it from scratch.

A ruling against the federal prohibition wouldn't automatically eliminate state restrictions or other regulatory requirements. But it could remove one of the biggest legal barriers to home distilling.

The AB take

We're not exactly rushing out to buy a still. We enjoy making blends and experimenting with whiskey, but actually distilling our own? That's a whole different level of commitment.

Still, the idea is pretty interesting. Maybe someday we'll give it a shot.

For now, we're happy letting the professionals make the whiskey while we figure out which bottles are worth drinking.
